Tuesday January 6, 2004 -- Board Meeting Minutes
Called to order at 7:40 p.m. The minutes from the December 2nd meeting were approved with one clarification - the new mailbox is an alternative to existing mailboxes.
Treasurer's Report: Printed on back of the minutes.
- Expenses mainly for common area mowing and fertilizing. Income from distribution of three disclosure packets.
- A reminder that 2004 dues notices will be distributed this month. Prompt payment is appreciated.
- The 2004 Budget was approved pending further cost review for Grounds & Maintenance. The final Budget will be distributed with next month's minutes.
Homeowner's Comments:
- The Board discussed a homeowner's complaint about dog waste in her yard. Article VIII, Section 1e of the Declaration of Covenants clearly states that "No household pet shall be permitted off the Lot occupied by such pets' Owner except on a leash." All homeowners are required to comply with this regulation. A reminder that dog waste must be cleaned up immediately by the dog owner and the dogipots are conveniently located for all to use. A sincere thank you to those dog owners who regularly leash and clean up after their dogs!
Committee Reports:
- Architectural Review
- An application was approved for the addition of a family room; a revised fence design was also approved.
- The ARC is concerned about unauthorized prefabricated sheds being used in the neighborhood. Please remember all sheds or exterior structures must be approved by the ARC and no plastic or prefabricated sheds are allowed.
- The ARC is developing a presentation for the MCS Annual Meeting to illustrate for homeowners the architectural guidelines and design characteristics established by Craig Builders. The aim of this presentation will be to inform homeowners of the key elements of design necessary to maintain the original character and beauty that drew us all the MCS.
- The ARC is still looking for a new member(s). Please contact Sally Mank (963-7962) if you are interested.
- Grounds and Maintenance: Thanks to Joe Gottlieb for all his work!
- VDOT has suspended paving operations for the winter - MCS will remain high on their priority list when work resumes in March or April.
- The removal of fallen and/or leaning common area trees is being held in abeyance. pending submittal of the remaining homeowners' plats of their lots showing the trees in question. Any homeowner who wishes to submit a plat for tree removal must do so by February 15th. Contractor quotes for all removals will commence thereafter.
- New gravel has been placed along the pathway in the fire road to make a 6ft. wide path. Additional funding was approved for labor costs relating to spreading the old pile of gravel that had long been next to the fire road between the fire road and the southerly entry to the Pond Trail.
- The pond overflow channel has been refurbished and cleared of debris.
- The required lowering of the pond's water level to clear the overflow risers of obstructing debris was attempted by All Seasons. Unfortunately, due to heavy rains, the streams feeding the pond kept filling quicker than it could be pumped. Although the contractor was able to open the riser's top grating and view the obstructing debris, the water level could not be sufficiently lowered to enable safe removal of the debris. The Board approved funds for costs related to an additional day's pumping during the attempt to lower the pond level. Subsequent to this work, County officials inspected the pond conditions. The Board approved the proposal to further research the cost and logistics of carrying out the County officials' recommendation that a substantial siphoning effort be attempted.

New Business:
- The Board discussed seeking advice regarding the legal interpretation and enforcement mechanisms for several facets of the MCS Covenants and Bylaws. It was decided that an attorney would be contacted.
- The MCSHOA Annual Meeting will be held Wednesday, March 10, 2004 at 7:30pm. Mark your calendar - more details in next month's minutes. Any homeowners interested in serving on the Board and/or a Committee are asked to contact a Board member.
